Customer Experience Review – Quarter 1 2025

1. Sponsor

The Customer Experience Review – Quarter 1 2025 Sweepstakes (the “Sweepstakes”) is sponsored by Avkin Inc., located at 103 S. James Street, Newport, DE 19804 (“Sponsor”). This Sweepstakes is in no way sponsored, endorsed, administered by, or associated with Amazon. By participating in the Sweepstakes, each entrant (“Entrant”) unconditionally accepts and agrees to comply with, and abide by, these Official Sweepstakes Rules and the decisions of Avkin Inc. (the “Sponsor”), which shall be final and binding in all respects.

2. Sweepstakes Period

The Sweepstakes begins on Tuesday, March 18, 2025, at 6:30 AM EST and ends on Thursday, May 1, 2025, at 5:00 PM EST (the “Sweepstakes Period”). All entries must be received before the closing date to be eligible.

3. Eligibility

The Sweepstakes is open only to Avkin Inc. customers who have purchased a wearable simulator in the past year, who are age 18 or older at the time of entry, and have received a Quality Assurance email with a survey link. Void outside this(these) geographic areas and wherever else prohibited by law. Sweepstakes is subject to all applicable federal, state and local laws and regulations.

The following individuals are not eligible to enter:

• Employees of Avkin Inc.
• Immediate family members (spouses, parents, children, siblings) of Avkin Inc. employees
• Household members of Avkin Inc. employees

Participation constitutes the entrant’s full and unconditional agreement to these Official Rules and Sponsor’s decisions, which are final and binding.

4. How to Enter

To enter, participants must complete the survey attached to the Quality Assurance Email they receive regarding their Avkin product purchase.

• Limit one (1) entry per person.
• There is no alternative method of entry (AMOE).
• No purchase or payment is necessary to participate beyond the initial product purchase required for eligibility.
• Entries must be received during an Entry Period to be eligible for that Entry Period’s prize.

5. Prize

One (1) winner will receive a $100 Amazon Digital Gift Card.

The prize:

• Is non-transferable
• Has no cash alternative or substitutions
• Is awarded “as is” without warranty or guarantee

The Sponsor reserves the right to substitute the prize with another of equal or greater value if the advertised prize becomes unavailable for any reason.

6. Winner Selection and Notification

• One (1) winner will be selected via a random drawing conducted by the Sponsor within five (5) days after the Sweepstakes Period ends.
• The potential winner will be notified via email and must respond within seven (7) days to claim their prize.
• If the winner fails to respond within the required timeframe, the Sponsor may, at its sole discretion, select an alternate winner.

7. Privacy Policy & Data Usage

• Entrants’ personal information will be collected and processed through HubSpot, Avkin Inc.’s Customer Relationship Management (CRM) system.
• The Sponsor will not publish the winner’s name.
• Information collected will only be used for administering the Sweepstakes and will not be sold or shared with third parties, except as required by law.

8. General Conditions

• Sponsor reserves the right to cancel, suspend, or modify the Sweepstakes if fraud, technical failures, or any other factor beyond Sponsor’s reasonable control impairs the integrity of the Sweepstakes.
• Sponsor reserves the right to disqualify any entrant who tampers with the entry process or violates these Official Rules.
• By participating, entrants release and hold harmless Avkin Inc. from any liability arising from participation in the Sweepstakes or acceptance/use of any prize.
• By submitting an Entry, entrant represents and warrants that the Entry conforms to these Official Rules and understands that Sponsor, in its sole discretion, may disqualify the Entry for any reason, including if it determines, in its sole discretion, that the Entry fails to conform to these Official Rules in any way or otherwise contains unacceptable content as determined by Sponsor, in its sole discretion.

9. Governing Law & Disputes

• This Sweepstakes is governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.
• All disputes arising out of or related to this Sweepstakes shall be resolved solely by binding arbitration and entrants waive the ability to bring claims in a class action format

BY ENTERING THE SWEEPSTAKES, ENTRANT AGREES THAT TO THE EXTENT PERMITTED BY APPLICABLE LAW: (A) ANY AND ALL DISPUTES, CLAIMS AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THE SWEEPSTAKES, OR ANY PRIZE AWARDED, WILL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION; (B) ANY AND ALL CLAIMS, JUDGMENTS AND AWARDS WILL BE LIMITED TO ACTUAL THIRD-PARTY, OUT-OF-POCKET COSTS INCURRED (IF ANY) NOT TO EXCEED TEN DOLLARS ($10.00), BUT IN NO EVENT WILL ATTORNEYS’ FEES BE AWARDED OR RECOVERABLE; (C) UNDER NO CIRCUMSTANCES WILL ANY ENTRANT BE PERMITTED TO OBTAIN ANY AWARD FOR, AND ENTRANT HEREBY KNOWINGLY AND EXPRESSLY WAIVES ALL RIGHTS TO SEEK, PUNITIVE, INCIDENTAL, CONSEQUENTIAL OR SPECIAL DAMAGES, LOST PROFITS AND/OR ANY OTHER DAMAGES, OTHER THAN ACTUAL OUT OF POCKET EXPENSES NOT TO EXCEED TEN DOLLARS ($10.00), AND/OR ANY RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED; AND (D) ENTRANTS’ REMEDIES ARE LIMITED TO A CLAIM FOR MONEY DAMAGES (IF ANY) AND ENTRANT IRREVOCABLY WAIVES ANY RIGHT TO SEEK INJUNCTIVE OR EQUITABLE RELIEF. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY, SO THE ABOVE MAY NOT APPLY TO YOU.

DISPUTES: The parties hereto each agree to finally settle all disputes only through arbitration; provided, however, the Released Parties shall be entitled to seek injunctive or equitable relief in the state and federal courts in New Castle County, Delaware and any other court with jurisdiction over the parties. In arbitration, there is no judge or jury and review is limited. The arbitrator’s decision and award is final and binding, with limited exceptions, and judgment on the award may be entered in any court with jurisdiction. The parties agree that, except as set forth above, any claim, suit, action or proceeding arising out of or relating to this Sweepstakes shall be resolved solely by binding arbitration before a sole arbitrator under the streamlined Arbitration Rules Procedures of JAMS Inc. (“JAMS”) or any successor to JAMS. In the event JAMS is unwilling or unable to set a hearing date within fourteen (14) days of the filing of a “Demand for Arbitration”, then either party can elect to have the arbitration administered by the American Arbitration Association (“AAA”) or any other mutually agreeable arbitration administration service. If an in-person hearing is required, then it will take place in New Castle County, Delaware. The federal or state law that applies to these Official Rules will also apply during the arbitration. Disputes will be arbitrated only on an individual basis and will not be consolidated with any other proceedings that involve any claims or controversy of another party, including any class actions; provided, however, if for any reason any court or arbitrator holds that this restriction is unconscionable or unenforceable, then the agreement to arbitrate doesn’t apply and the dispute must be brought in a court of competent jurisdiction in New Castle County, Delaware. Sponsor agrees to pay the administrative and arbitrator’s fees in order to conduct the arbitration (but specifically excluding any travel or other costs of entrant to attend the arbitration hearing). Either party may, notwithstanding this provision, bring qualifying claims in small claims court.
